The maternity benefit could be recalculated if mistakes were made when determining it, the Constitutional Court ruled on June 6 following a challenge from the lawyer of a woman plaintiff who had been in litigation with the National House of Social Insurance, IPN reports.

The Court accepted the arguments provided by the author of the challenge, who maintained that the mistakes made when determining the social insurance allowances and the impossibility of recalculating these, based on the challenged norms, violate the right to social protection and assistance and to maternity enshrined in the Constitution.

The Court held that the incorrect interpretation of the given provisions by the National House of Social Insurance led to the institution of a mistaken administrative practice in the recalculation of set allowances in case of errors and this is in breach of articles of the Constitution.
