Legal system in Moldova must become more transparent, judges

The newly elected members of the Supreme Council of Magistrates (CSM) consider that the judicial system of Moldova must become more transparent, while the reformation of the system must be accelerated, IPN reports.

Tatiana Raducan said the situation in justice should be changed. The CSM must be a really independent body that should defend the independence of judges. “The Council must change the attitude towards the judicial system. Transparency is needed. All the decisions of the CSM must be motivated so that society and the judges know why certain steps were taken,” she stated.

She also said that society must know the problems faced by judges and the denigration of judges must stop as there are judges who are good indeed. The judges who will not cope with the requirements will be asked to leave the system. The task of the CSM is to accelerate the reform in justice, which is awaited by society and the European institutions. Greater transparency is needed on the part of the CSM members.

Anatol Turcan said he will be much more active at the CSM. “The reform in justice started long ago. We have discussed this reform since the proclamation of Moldova’s independence. It seems to be endless and thus should be done more intelligently,” he stated.  

Dumitru Visterniceanu said he trusts the judicial system of Moldova as it can appropriately solve a lot of problems. But there was no united position inside the CSM and they doubted that the Council can meet the requirements. Now the situation started to change, but they must modify the work and decision-making method so as to ensure transparency and to make the decisions more convincing.

Outgoing CSM president Nichifor Corochii, who applied to enter the new composition of the Council, but didn’t poll the necessary number of votes, said he expected such a result. “It’s fair as my colleagues voted for those whom they want to see in the CSM. I do not have regrets after managing the Council for four years. There are yet many things to be done. We didn’t manage to obtain a special status for the profession of judge as regards the salary and social guarantees and the work conditions,” he stated, adding he doesn’t know if he will run again for the post of CSM president.

On October 18, the General Assembly of Judges elected three new permanent members of the Council. Another three candidates didn’t win the necessary number of votes. The Assembly was also to choose two substitute members of the CSM, but the candidates could not garner the votes they needed. The voting will be rerun in December, when the General Assembly will be convened again.
