Lawyers are protesting in front of the Parliament Building, where the MPs are holding a sitting, demanding to annul the amendment proposed by PAS MP Olesea Stamate to the law on advoancy. The given amendment excludes the text “ the lawyer cannot be detained, brought by force, arrested and searched without the preliminary consent of the Council of the Lawyers Union, except for cases when the person is caught red-handed”, IPN reports.
Lawyer Iurie Mărgineanu said that if Olesea Stamate’s amendment is not withdrawn, all the members of the Lawyers Union will join the protest on January 24.
The legal commission for appointments and immunities that is headed by Olesea Stamate is accused of abuse and of misleading the MPs and the lawyers guild. The lawyers noted that during the state capture, they were persecuted, wiretapped and arrested and they therefore insist on keeping the guarantees provided currently by the law.
They said the proposed amendment didn’t go through the stages of legislative procedure and decisional transparency wasn’t obeyed. Before being submitted to Parliament, it should have been discussed with the lawyers so as to reach a compromise with them.
The lawyers also ask to amend Article 10 of the law on advocacy, which enables the prosecutors and judges to enter the bar without exams, said lawyer Vadim Vieru. As to the strike announced by lawyers, Vadim Vieru said the hearings are canceled one after another.
