Lawyer Vitalie Taulean asks to start a criminal case against the prospectors who deal with the death of a minor at the placement center “Vatra”. According to him, the prosecutors abusively and illegally charged the center’s social assistant with intentional murder and its manager with abuse of power.
In a news conference at IPN, Vitalie Taulean said there were no legal reasons to arrest the placement center’s manager and social assistant. The prosecutors do not have clear evidence showing that the two are to blame for the death of the minor.
According to the lawyer, the female manager of the center cannot be blamed for the death because the boy was brought by the police in the evening, when she wasn’t at work, and the social assistant didn’t inform her about the newcomer. The 11-year-old boy was brought from the street. He was agitated and behaved as if he inhaled glue. He was taken to a room of the center and the social assistant could calm him down only towards 3am. In the morning, the minor was found dead. This was poisoned by carbon monoxide emitted by the bed mattress that burned partially.
“The prosecutors had to invoke a particular point from particular regulations and to prove that there was a causal connection between the action of the manager, who left home legally at 6:30pm, and the child’s death. It is evident that no such legal connection exists,” stated the lawyer.
Vitalie Taulean noted that neither the manager nor the social assistant of the center can be blamed in this case. The latter could not presume that the boy will set the mattress on fire and will get poisoned.
According to the lawyer, initially the manager and the social assistant were investigated under arrest, but were later set free. “The court ruled that the actions of the persons do not represent an offense. The judges said there are no clear components of the offenses of murder and abuse of power. It means that the prosecutors invoked irrational arguments,” stated Vitalie Taulean.
The placement center “Vatra” was closed on a temporary basis. The investigation into this case continues.
