The MPs carried in the final reading a bill to optimize the administration of state-owned and municipal enterprises. The document regulates the particularities concerning the founding, functionality and closing of state-owned and municipal enterprises and the method of managing the property transferred to these, IPN reports.
A minimum ceiling of 5,000 lei will be set for the registered capital of enterprises. There will be established a special legal regime with the distinct registration in the accounting records of public and social assets so that these could not be sold.
As regards the management of state-owned and municipal enterprises, the powers of the administration board will be extended so that this determines the performance indicators of enterprises and assessment criteria, approves the business plan and monitors its implementation, supervises litigation, approves the regulations on the purchase of goods, works and services and chooses the manager at a contest.
The informative note to the bill says the powers of the founders and managers of state-owned and municipal enterprises will be broadened. In particular, the founder is to authorize the purchase of property whose value represents over 25% of the value of net assets or exceeds 400,000 lei.
In 2016, the local public authorities managed approximately 550 municipal enterprises, while the central public authorities about 250 state-owned enterprises.
