Komaksavia Airport Invest Ltd says that the decision of the Stockholm Arbitration Institute to reject its claim against the Republic of Moldova is merely “intermediate” and will be challenged in a higher Swedish court.
The company also says that the court did not examine the claim on the matters, but only on its admissibility under the Convention on Investment Protection between the Republic of Moldova and Cyprus.
Moreover, Komaksavia says the position of the Moldovan Ministry of Justice is “manipulative”, and terminating the concession agreement is “out of the question”, as the company will further “seek justice” in other international courts.
On Wednesday, Minister of Justice Sergiu Litvinenco announced that the Arbitration Institute of the Stockholm Chamber of Commerce rejected the lawsuit filed by Komaksavia against Moldova, offering the latter €216,678.75 in costs.
In May 2020, Komaksavia sued the Moldovan government over the latter’s attempt to terminate the company’s concession of the Chisinau Airport.
