Judge of Military Court to be investigation

A judge of the Military Court will be investigated for intentionally passing an illegal judgment. The Superior Council of Magistracy on April 11 gave the go-ahead to take legal action and hold the judge accountable, IPN reports.

According to the Prosecutor General’s Office, in the autumn of 2016, examining a procedure for reviewing the criminal proceedings against a person convicted in 2000 of negligent attitude to the job, of which he was later acquitted, the judge erroneously ordered to drop the case. The review of the decision to drop the case took place in breach of the statute of limitations, which expired nine years ago. Consequently, the given person can be freed from paying damage imposed on this by the civil court decision that was partially implemented. 

Now that the Superior Council of Magistracy gave its consent, the prosecutor general is to take legal action against the judge, who faces three to seven years in jail and ban on holding particular posts or performing particular activities for a period of up to five years.
