Secretary general of the Party “Dignity and Truth Platform” Ion Terguță said the assumption of responsibility by the Chicu Government for a package of laws during the state of emergency and the non-presentation of the government coalition at the Parliament siting are the most perfidious political actions in the last few years or, possibly, in the whole history of the Republic of Moldova. Moreover, after the Constitutional Court declared the package of laws unconstitutional, Prime Minister Ion Chicu should resign, IPN reports.
“The Chicu Government probably wants to adopt the same manner of government as the Filip Government, but the government was brought to extreme limits. They came to Parliament and pretended to have assumed responsibility before Parliament, but bypassed Parliament in a way that defies any logic. The Constitutional Court is the only institution in this state that told them that they acted incorrectly. If Prime Minister Chicu, as he said, assumed responsibility or, in plain words, risked his mandate of Premier on the adoption of this law, he should now be principled and resign. Normally, the Government should fall,” Ion Terguță stated in the talk show “Expertise Hour” on Jurnal TV channel.
MP Sergiu Sîrbu, of the Pro Moldova group, said the principles of urgency, regulation and celerity of the adopted norms were violated in the process of assuming responsibility.
“The way in which the Government came with this assumption of responsibility was vitiated from the start. They seriously violated the law from the beginning as the Constitution provides that the procedure should be performed before the MPs, not in front of Parliament or in front of empty seats. A quorum should have been present at the Parliament sitting,” stated the MP.
Sergiu Sîrbu noted the opposition didn’t challenge the procedure, but particular parts of the law that had nothing to do with the measures taken to contain the COVID-19 pandemic.
“We wanted those schemes and hidden interests to be annulled. The Court decided differently. It annulled the whole law.”
Jurist Stanislav Pavlovschi said those who went to the Constitutional Court didn’t expect the judges to annul the whole package of laws.
“From legal viewpoint, no one can deny the authors’ right to file such challenges. They insisted on provisions that generate constitutionality-related problems. The Court followed another path and analyzed the law on the whole. Everyone understands that in this exceptional situation, the Government followed an exceptional way, but with some violations. The Constitutional Court acted correctly and couldn’t have adopted another decision,” he stated.
PAS MP Sergiu Litvinenco said the Constitutional Court’s judgment showed that Igor Dodon and Ion Chicu actually defied and ignored the Constitution.
Democratic MP Nicolae Ciubuc said the Democratic parliamentary group was absent from the sitting because of the exceptional situation in the country. They considered the opportunity and necessity of being present at the sitting. They issued a press release and explained that the PDM supports the initiatives included in that package that had been discussed and agreed by the government coalition.
The politician noted the legislation does not stipulate the necessity of ensuring a quorum so as to examine the Government’s report on the assumption of responsibility.
