The legislation on the social protection of children is a complex one, but this can be improved, shows the first assessment of the impactor the law on the social protection of children in situations of risk and children separated from parents. Independent expert Ina Sotski, in the meeting of the Parliament’s commission on social protection, health and family, said both the institutional approach and the managerial approach should be adjusted, IPN reports.

According to the expert, the legislation should stipulate the obligation to hire a specialist in the protection of children’s rights who would be remunerated with state budget funds. It is recommended instituting a new legal procedure for examining cases of authorizing the separation of children from the family for a short period, deprivation of parental rights or taking of the child away from the family. The procedure implies the existence of specialized teams that would examine the disputes as a matter of urgency.

The ex-post assessment is one of the parliamentary control instruments. Parliament hasn’t used this so far. This will enable to analyze the data about how the law was implemented, if all the necessary documents were approved, what the impact on society and on specific areas or groups was, what the economic, financial, social and administrative effects are.

According to the preliminary report, there were 35,441 children separated from parents in Moldova at the end of 2017. The parents or the only parent of 30,320 children of these worked abroad, 1,079 were classed as children who remained temporarily without parental care, 3,749 were classed as children who remained without parental care, while 293 children were taken away from their parents given the existence of imminent risks to their life and health.
