Ilan Șor’s right to defense is being violated, lawyers

The lawyers for Ilan Șor said the MP’s right to defense is being violated. Even if they were allowed to attend the meeting of the Parliament’s legal commission for appointments and immunities, which is examining the lifting of the parliamentary immunity, they didn’t have access to the materials. Therefore, the lawyers left the meeting after the examination of the third request of the nine made by the Prosecutor General’s Office, IPN reports.

“We were allowed to attend the meeting, but all our rights enshrined in the Constitution were violated. The right to defense was encroached upon. The nine requests made by the prosecutor general are accompanied by 320 files for each request, but the commission categorically refused to allow the lawyers to familiarize themselves with the annexes and requests,” lawyer Aurel Colenco told a news conference.

Layer Denis Calaida said that as they do not have access to the materials, they cannot pronounce because they do not know details.

MP Marina Tauber said this is mockery not only at Ilan Șor, but at the whole society. The lifting of immunity is a political order, but Ilan Șor does not need parliamentary immunity and he himself proposed excluding this.

The requests submitted by the Prosecutor General’s Office to strip MP Ilan Shor of immunity are being examined in a meeting behind closed doors. The prosecutors requested to lift the parliamentary immunity so as to detain, arrested, search and send to court Ilan Șor on a number of charges, such as large-scale swindle, money laundering, creation and management of a criminal organization, falsification of documents, appropriation and abuse of power. In accordance with the Parliament’s regulations, the MPs will pronounce on the prosecutor general’s request in a secret ballot.

Ilan Shor, who has been absconding from justice since June 2019, reacted by saying this was “a show staged” by President Maia Sandu to divert public attention from pressing problems. Shor was previously stripped of immunity in August 2019.
