“The assumption of responsibility procedures should be consulted with the parliamentary commissions, with all the groups. Even in situations of crisis and exceptional situations, Parliament cannot be isolated and cannot have its powers limited,” PPPDA MP Igor Munteanu, who heads the parliamentary public finances control commission and served as Moldova’s ambassador to the U.S., stated in a public debate titled “Assumption of responsibility by the Government: controversies, effects, solutions”, staged by IPN News Agency.

“Governance based on the assumption of responsibility in a crisis situation is a very dangerous path and I’m glad that the Constitutional Court examined not only the challenges related to the three points and declared the whole law for which the Government assumed responsibility unconstitutional. The Court identified a danger to the constitutional order. The separation of powers in the state was in danger. Even in situations of crisis and exceptional situations, Parliament cannot be isolated and cannot have its powers limited. It cannot suffer as an authority because of the executive’s dominant role over all the important aspects – budgetary, intervention measures. Without consulting Parliament, these measures cannot be legitimate,” said Igor Munteanu.

The vice president of the PPPDA stated that in the created situation, the Government’s duty is to ensure consensus in society, but that consensus will not be reached if the authorities do not take the separation of the state powers into account.

“The Constitutional Court advised the Government not to repeat the same mistakes. The assumption of responsibility procedures should be consulted with the parliamentary commissions, with all the groups. The role of governments in crisis situations is to create consensus and confidence in society. The Government can be very well outfitted in terms of legal, economic powers, but these actions in the absence of a consensus generation camp cannot follow the necessary direction and cannot lead to the achievement of the main objective. We will be able to reach consensual reactions only when someone will not try to gain political or electoral advantages only, without realizing that the institutions in a democratic state work based on the separation of powers in the state, on constitutional norms that should be respected. In such a case, we will not have consensus and mobilization of all the national resources,” noted the MP.

The April 2 law for which the Government assumed responsibility was adopted with violations of the constitutional provisions and is unconstitutional, the Constitutional Court ruled on April 13.
