Government rejects denouncing the Memorandum on principles of stabilizing relations between RM and Transnistria

The Government rejected the decision draft of the Parliament dating May 15 “Regarding the denouncing of the Memorandum on principles of stabilizing relations between and Transnistria”, which provides the Transnistrian region with the right to make external economic activities. According to a Government’s notice, the Memorandum of May 1997 is one of those over 130 documents concluded within the negotiation process, so it is not an international juridical act and, as result, it cannot be denounced. In the notice is also mentioned that, taking into account the provisions of the Vienna Convention on the Law of Treaties, which is applied on treaties-agreements concluded between states, by the words „part to treaty” it is meant that the state agreed to enter the treaty. In this sense, the possible initiation of the memorandum denouncing procedure, in light of the provisions of the Convention of Vienna, shows that RM recognizes the quality of the Transnistrian region as international law-based state. The notice also says that similar provisions are stipulated by the Law on international treaties of Moldova of September 1999, stipulating that “denouncing or terminating international treaties of RM are done pursuant to principles and norms of the international law, with the Convention on the Law of Treaties”. The Parliament’s decision draft on denouncing the Memorandum was issued by the deputies of the Alliance „Moldova Noastra”, Vitalia Pavlicenco and Valeriu Cosarciuc.
