The Government’s work program for 2015-2018, which will be presented in Parliament on February 12, proposes reviewing the legal framework so as to reduce the regime of immunities for persons with public posts and special status within criminal and administrative proceedings, IPN reports.
The executive aims to invite a mission of EU experts to offer assistance to the law enforcement bodies and the courts of law/specialized judges in examining cases of corruption.
To combat corruption, a strategy will be adopted to avoid the doubling of powers between the National Anticorruption Center, the Anticorruption Prosecutor’s Office, the National Integrity Commission and the courts of law/specialized judges in the examination of cases of corruption. The functional independence of the National Anticorruption Center and the Anticorruption Prosecutor’s Office will be ensured in accordance with the Association Agreement with the EU.
The program also says that the Law on Party and Election Campaign Funding must be adopted so as to not to allow financing from abroad. A mechanism will be created to uniformly implement a formula for setting the cap on financial resources that can be transferred to the election runner’s electoral fund. Legal punishment will be instituted for not declaring the expenses or for spending more than allowed.
The Government considers it is necessary to promote the principle of rotation of managerial posts in the legal system and the prosecution service. To combat corruption, the salaries in the anticorruption sector (judges, prosecutors, employees of the National Anticorruption Center and the National Integrity Commission) will be adjusted.
The executive also suggests creating a body with powers to identify, recover and administer the goods coming from criminal activities, which are on Moldova’s territory or abroad. Among other planned measures are to institute special confiscation and extended confiscation of property coming from corruption and related offenses and to create a civil confiscation mechanism.
