Ghelici reports scheme to dispossess about 300 persons

The head of the Public Association “Moldova Mea” Fiodor Ghelici said that lawyer Andrei Nastase represented in court a joint stock company that, using false documents, deprived about 300 persons, most of whom are pensions, of ownership rights. In a news conference at IPN, Fiodor Ghelici requested the Anticorruption Prosecutor’s Office to examine this case.

Fiodor Ghelici said that at 65 Dacia St, not far from the Chisinau International Airport, there is an area of 2.5 hectares of land with 17 constructions on it. Until recently, the territory was owned by the joint stock company “Avant”, but, following a Supreme Court of Justice judgment that was passed based on false documents, the land was transferred to SA “Drum 96”, which owned 16% of the share capital of “Avant”. After the procedure to liquidate “Avant” was initiated, the 298 majority owners, who in the 1990s worked at the company and were apportioned a share, remained without property after this was transferred to “Drum 96”.

According to the activist, the staff of SA “Avant” worked under a normal regime until 2010, when the decision to liquidate the entity was taken. At that moment, the company had debts of about 20 million lei to the state and to Banca Sociala. Shortly after the liquidation procedure was started, “Drum 96” went to court and asked to recognize its right to own the 17 constructions located on the territory of SA “Avant”, based on an agreement signed about 20 years ago, which showed that the buildings were leased out to “Avant”.

Fiodor Ghelici said the first court rejected the complaint and refused to recognize the ownership right of “Drum 96”. The Appeals Court upheld the decision, but the Supreme Court of Justice ruled in favor of the plaintiff and deprived the about 300 shareholders of the ownership right.

The administrator named by the state at SA “Avant” informed the Prosecutor General’s Office, saying an expert appraisal showed the documents presented by “Drum 96” in court were false. Ghelici said the person against whom the criminal case over use of false documents was started died, but there is an administrator of SA “Drum 96”, who transmitted the documents to court and this wasn’t held accountable .

The head of “Moldova Mea” concluded that in order to win such a case in court, a very good jurist and serious bribe are needed. According to him, lawyer Andrei Nastase is behind this scheme. The shareholders will go to the ECHR to seek justice and will be helped by the public association in this approach.
