The ex-prosecutor of Chisinau municipality Ivan Diacov said the prosecution service became a political instrument and this is proven even by the cases of former Premier Vlad Filat, mayor of Orhei Ilan Shor and judge Domnica Manole. According to Ivan Diacov, as during the Soviet Union, they invoke the secrecy of investigations into cases that must be examined publicly.
In a news conference at IPN, the ex-prosecutor referred to the case of Vlad Filat, who was recently sentenced to nine years in prison. According to him, the examination of this case behind closed doors is not typical of a democratic society. He was informed that the sentence does not contain the reasons invoked when Vlad Filat was arrested – bribe of US$250 million and other facts admitted by this in Parliament. The ex-Premier was found guilty only of accepting expensive presents, including watches, vehicles, etc.
Ivan Diacov said that Vlad Filat must be punished for the violations that he admitted. The prosecutor, who insists on a public trial, considers that the defense also does not want the people to know what was discussed in the hearings. Though the defense repeatedly invoked the violation of the freedom of expression, they didn’t make use of the possessed tools. Vlad Filat could have recorded the hearings through the agency of his lawyer, but he didn’t want to because he is one of those who impoverished the people.
The ex-prosecutor referred also to the remand detention practice, saying that Moldova should use the experience of other states where the culprits pay to be released on bail. This way the rights of the defendants are not violated and the state budget also gains.
As to the case of judge Domnica Manole, who is accused of taking an illegal decision when she obliged the Central Election Commission to hold the constitutional referendum initiated by the Platform “Dignity and Truth”, Ivan Diacov said this is a method to show who controls things in the country. The current government prepares for presidential elections and makes sure that the judges take decisions in its favor if there are lawsuits. Judge Manole was subject to pressure, but she passed a judgment based on the law and on her own conscience. The request to withdraw her immunity and her prosecution will be classed by the international community as interference and this case will not be tolerated by the development partners.
Ivan Diacov also said that if the post of prosecutor general is held by a person from civil society, justice will be definitely done and those involved in the banking frauds will be held accountable. The government, by its abusive and illegal acts, transformed the prosecution service into a political weapon and establishes dictatorship.
