Experts about new challenge filed by PSRM to CC

Jurists describe the Party of Socialists challenge to the Constitutional Court (CC), by which they ask to annul the first presidential decree to nominate Natalia Gavrilița as a candidate for Prime Minister, as a desperate attempt to gain time. According to them, the challenge will be rejected as the decree already produced legal effects, IPN reports.

The MPs of the PSRM challenged the decree for the reason that this wasn’t published in the Official Gazette.

“This attempt to gain time shows how desperate the Socialists are. It’s clear that the PSRM is not ready for a denouement, not matter what this is. The snap elections are an exercise that could change the situation, but they should not be held in the current pandemic conditions,” jurist Ștefan Gligor said in the talk show “Secrets of the Power” on JurnalTV channel.

Moreover, constitutional law experts consider the probability for the CC judges to rule in favor of the Socialists is very low as the challenged decree produced legal effects in Moldova’s Parliament.

“Such a challenge will not be successful at the Constitutional Court. The PSRM should have taken such a step when Natalia Gavrilița was nominated,” stated constitutional law expert Teodor Cârnaț.

On March 24, representatives of the PSRM asked the CC to pronounce on the constitutionality of the presidential decree to nominate Natalia Gavrilița as a candidate for Prime Minister as this wasn’t published in the Official Gazette. On February 11, Parliament didn’t give a vote of confidence to the Cabinet proposed by Natalia Gavrilița. The second nominated candidate Igor Grosu is to present his government program and team in Parliament today. If two attempts to vote in the Government fail, circumstances for the dissolution of Parliament appear.
