Entrepreneurs could challenge inspection decisions in court

Entrepreneurs will be able to dispute inspection decisions in court. If inspectors commit abuses, they will be penalized. There will also be a clear delimitation between “recommendations” and “indications” given by inspectors. This is stipulated in a draft law that was given a first reading by Parliament, IPN reports.

The draft stipulates that inspection plans will be unified, taking into account different types of economic agents and risks. The conditions for unannounced control will be reviewed and specific grounds for control over economic agents that intentionally evade inspections will be included.

The inspection body, in case of contraventions, will act as an ascertaining agent and will strictly check only the information or objects necessary for ascertaining the contravention and will not have broad inspection duties.

The bill was drafted by the Ministry of Economic Development and Digitalization. The authors noted that the legislative changes aim to develop an efficient and predictable inspection system, to reduce the burden of inspections and unfair penalties, to encourage investment.
