Employers have less than five months to issue employees’ cards

The Law that forces employers to issue ids for their employees does not apply to those who have already done it. This means that the old type of ids still holds. According to Victor Turcanu, head of the Labor Inspection’s Law enforcement Department, the amendments to the Labor Code and Administrative Code have already become effective, and employers have less than 5 months, till the beginning of 2013, to comply with the new requirements, reports Info-Prim Neo.
The staff list forms and the model for the nominal access permit to the workplace have been published in the July 20 issue of the Official Gazette. Employees will not be obligated to display their permits, but will have to show them to Labor Inspectors if the latter request it. This measure aims at combating the phenomenon of undeclared labor. The id must contain info about the employer, the picture of the employee and his position. Meanwhile, the staff lists an employer must hire have also been approved.
“All institutions are to introduce mandatory ids for all employees. If the employer does not issue ids, he/she will be fined for up to 1,500 lei. This fine is not fixed; the inspectors will issue minutes that would be later forwarded to the court, which will rule upon the increase of the fine”, stated Victor Turcanu.
According to the Inspection of Labor, the identification of employees is necessary, in order to know the people located within the territory of an enterprise, institution, or organization. The number of the id should correspond to the number of the individual contract that had been signed by the employer and employee. Authorities say that this will help competent institutions to fight the phenomenon of undeclared labor.
