The Labour Inspection recommends the employees from all the fields of the economy to call on 499400 if their legal right to annual vacation have been violated. According to General State Inspector Dumitru Stavila, although the Labour legislation was not amended recently in what concerns vacations, most of violations in this respect are registered in the summer period. Employees should know that they have the right to annual vacation for at least 28 days. The employers can not decide on their own the period of the year when the employee will go on a leave. The schedule of vacations is fixed by mutual consent with the employees, by at least two weeks before the expiration of the year and can be changed only in exceptional cases, with the consent of the employees. All the employees, both working in the private or state-paid field, benefit from vacation indemnity. It equals the average salary per day (calculated on the basis of all the earnings) multiplied by the number of vacation days. The employers are obliged to pay the vacation indemnity at least 3 days before the employee goes on the leave. The vacation can be divided into parts, even at the initiative of the administration, but a part of the vacation can not be smaller than 14 days. In case the period of the vacation coincides with national holidays, the length of the vacation has to be prolonged. The same thing happens if the employee gets seek and benefits from a sick leave. In case the company is incapable of working, the administration has the right to announce technical unemployment, but no more than for three months, period within which the employee has the right to at least 2/3 of the average salary. The Labour Inspection guarantees the anonymity of the petitions sent by the employees. The petitions can be both collective and individual. The signers of the petitions can claim damages if their rights are violated.
