Eduard Musuc remains in custody

Eduard Musuc will remain in custody for an undetermined period, as he did not succeed in offering the 2 mln lei bail, set by the court, his advocates, Alexandru Tanase and Ghenadie Tatar, told reporters on Thursday 26 October.
Alexandru Tanase stated that there are no legal instruments for contesting the bail of 2 mln lei, which, according to the cited source, has not any precedent in Moldova. According to the cited source, the relatives of Eduard Musuc did not succeed in gathering this sum of money.
As Tanase stated, covering the named sum by mortgaging the apartment, car and a plot of land that are in the property of Eduard Musuc, is also impossible, as they were subjected to sequestration.
The lawyers have also claimed a series of infringements that the legal authorities committed in the case of Musuc, as the violation of the principle of equality of defense and accusation in front of the court and that of the justice independence, mentioning that a petition was submitted to the Superior Council of Magistrate requesting cancellation of immunity and subsequent penal proceedings against the judge that ordered the arrest.
The advocates have also mentioned that on Friday they were offered the possibility to communicate with their client and to get familiar with the case. Till now, they had to communicate through the “well-known glass wall” of the cell from the Center for Combating Economic Crimes and Corruption (CCECC), a wall that, according to the cited sources, makes impossible both a confidential discussion, leaving room for suspicions that the discussion is registered, and the analysis of certain documents, fact that is absolutely necessary in a lawsuit of economic nature.
The lawyers stated that they prepare petition that will be submitted soon to the European Court of Human Rights.
On September 28, 2006, the Court of Buiucani district issued an arrest warrant for ten days on the name of Eduard Musuc, at the request of the CCECC. Eduard Musuc, as well as his father Ion Musuc, is accused of appropriating a building on Alba Iulia Street, 77, which belonged to “Mold Itel” JSC.
Musuc pleads not guilty and asserts that it is about a political action, launched by the government party.
