ECHR decision shows authorities haven’t solved problem of farmers from Dubasari, opinion

The judgement passed by the European Court of Human Rights, which held that the land ownership rights of the farmers from Dubasari were violated, shows the Moldovan constitutional authorities haven’t achieved palpable results in solving the problem, security expert Rosian Vasiloi stated in the program “Emphasis on today” on TVR Moldova channel, IPN reports.

“From technical viewpoint, the Court pronounced on the role of the authorities of the Republic of Moldova and the whole responsibility is actually placed on the Russian Federation. Moreover, the Court’s decision mentions also the previous decisions that haven’t yet been implemented by the Russian Federation. In my opinion, neither the authorities of the Republic of Moldova do something to sensitize the Russian authorities to the need to implement this ECHR decision,” stated Rosian Vasiloi.

The expert said the given farmland divides the Transnistrian region into two and offers Moldova access to the Moldovan-Ukrainian state border through the Transnistrian segment. One of the versions is that the Transnistrian regime sequestrated this land.

Promo-LEX Association executive director Ion Manolen said the ECHR ruled in favor of the over 1,600 plaintiffs who are all farmland owners from the villages Dorotcaia, Parata, Cocieri, Cosnita and Molovata. “The Court ascertained the violation of the ownership rights and the lack of efficient remedies for defending the violated rights,” he stated.

According to Ion Manole, the regime in Tiraspol controls the road that separates the five villages from the farmland owned by these. Now that they have such a decision in their hands, the Moldovan authorities should at least adopt a different position. “Regrettably, having 13 decisions on cases referring to the Transnistrian region, which ascertain the violation of different articles, not of only one article, Chisinau cold not impose its position in the talks,” he stated, noting there are also international players that, in their wish to obtain political advantages, exert pressure on those from Chisinau.

The European Court of Human Rights on July 17 passed a decision in the case of the farmers from Dubasari district, whose land was sequestrated by the secessionist Transnistrian administration. The Court ordered that Russia should pay €2 499 300 damages to the plaintiffs. The application was filed in the name of 1,646 plaintiffs and three agricultural companies from Dubasari district that were represented at the ECHR by lawyers of Promo-LEX Association.
