Each fourth decision is quashed by Supreme Court of Justice

About 75% of the court decisions in 2014 were upheld after they were examined by the higher courts, while approximately 25% were quashed or modified,”  the president of the Supreme Court of Justice Mihai Poalelungi said in the online program “Without myths” on pan.md, IPN reports.

Poalelungi noted that if the decisions of a judge are overturned by a higher court, this judge is usually held disciplinarily accountable.

“The fact that one quarter of the court decisions are quashed does not mean that the wrongdoings dominate in the country. In 25% of the cases, the Supreme Court of Justice has another decision, which is different from that of the first court. This can mean lack of professionalism, mistakes, and violation of the imperative norms by judges of the lower courts,” he explained.

Mihai Poalelungi is convinced that all the judges who pass illegal judgments and did it deliberately should be held criminally accountable.
