Dem lawmaker seeks CC interpretation to avoid ‘power vacuum’

Democrat Sergiu Sîrbu has formally asked the Constitutional Court to tell whether a caretaker Government, in a “vacuum of legislative power” situation, may adopt ordinary and organic laws so as to “ensure continuity of governance, economic and financial security, national security and defense capability”, IPN reports.

Moreover, the lawmaker is asking whether “a perpetuation of a parliamentary blockage and prolonged power vacuum” would be “acceptable” from a constitutional viewpoint in case of snap elections induced by the failure to form a majority in Parliament and consequently to appoint a Cabinet.

Also, the Constitutional Court is asked whether a caretaker Government “has an obligation to take all the steps necessary” to ensure that the government is functional in case of a deadlock in Parliament.

Sîrbu claims there’s an “eminent risk of a power vacuum and legislative blockage” as practice showed.
