CSM: There is no legal basis for the participation of judges in the General Assembly

The Superior Council of Magistracy argues that there is no legal basis for the participation of judges in the General Assembly of Judges convened on September 27 according to the Conclusion of the Chisinau Court of Appeal of September 24. According to the CSM, the decision of the Court is to be contested, IPN reports.

In a decision issued on September 26, the Superior Council of Magistracy states that it took note of the conclusion of the Chisinau Court of Appeal of September 24, which ordered the execution of the decision of September 20, regarding the extraordinary sitting of the General Assembly of Judges on September 27, 10.00 am, with the draft agenda proposed.

The Council decided to inform the judges of the courts that the conclusion of the Court of September 24 can be appealed, and that it is not a final and enforceable conclusion. The Superior Council of Magistracy specifies that it will contest it within the term provided by law.

The Chisinau Court of Appeal adopted on September 24 a conclusion ordering to convene the extraordinary meeting of the General Assembly of Judges on September 27, at 9.00 am, at the Trade Unions House. The Association of Judges mentions that the conclusion comes to enforce the decision of the Chisinau Court of Appeal dated September 20, by which the Superior Council of Magistracy was ordered to convene the Assembly.

The conclusion of the Chisinau Court of Appeal also establishes the agenda of the extraordinary session of the General Assembly of Judges, which would include two topics. The first is the revamping and restructuring of the self-administration body of the judicial authority. The second issue is the lifting of the mandates of the permanent and alternate members of the CSM, elected from among the judges.
