The Association “Promo-LEX” ascertains with concern that the courts of law continue to impose too mild penalties on domestic aggressors. A discrepancy thus appears between the punishment for aggressors and their deeds. The lawyers of “Promo-LEX” consider the symbolic punishments encourage further domestic violence, IPN reports.
In a press release, the Association says that the Buiucani Court on December 9 put an aggressor on probation for a five years period even if this was accused of committing four offenses: illegal deprivation of freedom, domestic violence against the female partner and the minor daughter, hooliganism and non-fulfillment of a court decision.
Starting with 2014, the offender has repeatedly abused the woman and his minor child, especially after the victim decided to leave the common home and to submit a complaint so that the man was investigated for use of violence.
The prosecutor asked for seven years’ imprisonment, while the injured party and her lawyer asked for the maximum penalty in each of the counts. However, the court dropped the charges in two of the cases based on the Amnesty Law and gave a suspended sentence in the other two counts.
“Promo-LEX” lawyer Dumitru Sliusarenko said that even if the domestic aggressor during three years caused serious suffering to his partner and the minor child, this was given a too mild sentence for his deeds. The courts tend to impose milder penalties in most of the cases of domestic violence, without jailing the aggressors, but impose much harsher punishments for offenses of similar gravity. The offenders are thus not discouraged from stopping to commit new acts of violence.
In conclusion, “Promo-LEX” warns the authorities that the courts play a decisive role in preventing domestic violence. The mild punishments discourage the victims from complaining to the police.
