Courts cancel Chisinau mayor’s decision halting construction works

The courts cancelled an ordinance suspending work on a building site located on 26 Renasterii Boulevard, issued by the Mayor General of Chisinau Dorin Chirtoaca in November 2007. At that time, the builder was in conflict with the residents, Info-Prim Neo reports.
At the City Hall’s meeting on January 28, the mayor said that the municipal authorities appealed against the court decisions, including of the Court of Appeals Chisinau, to the Supreme Court of Justice.
Gheorghe Railean, head of the Construction Discipline Division, said that the construction authorisation issued to the builder in 2006 was extended with deviations as the indicated address did not coincide with the one from the construction authorisation. The indicated address – 29 Renasterii Boulevard - was the address of a plot of land from across the street.
Dorin Chirtoaca instructed the Legal Division and the Construction Authorisation Division to thoroughly prepare the defence and to inform the mass media and residents that are in conflict with the builder about this case. “There are cases when the court does not take into account the realities and solve the cases not fully equitably,” the mayor said.
Gheorghe Railean said that the builder addressed a letter to the City Hall warning that if it does not receive an answer about the possibility of continuing the construction by January 28, it will start the works.
The head of Rascani district, Mihai Carlig, said that the building company will not be allowed to continue the works until it presents all the necessary documents to the City Hall. He added that the people living near the building site protested on January 23, came into altercation with the police and even blocked Renasterii Boulevard.
The reality is that no construction is possible if there is a conflict, the mayor said. According to Chirtoaca, in such cases the people throw themselves under the bulldozer, block the traffic etc. That’s why, he said, the builder should take this into account and reach a compromise with the residents. Otherwise, the residents will react accordingly.
