Court ruled in favour of children claiming right on their deceased father’s apartment

Botanica District Court ruled in favour of the children who were claiming their right on the apartment of their deceased father, lawyer Octavian Varlan of the Centre for Children’s Rights (CDC), who represents the interests of the children in the court, told Info-Prim Neo.
According to the lawyer, the court declared as null the sale contract for the apartment, sold on the basis of a proxy issued by the children’s father to his sister.
After the divorce of the parents the children were raised by their mother. The man passed away in August 2006. According to the legislation in force, his apartment in Chisinau is to be due to his first degree inheritors - his three children in this case. Shortly after the funerals, the man’s sister, a professional in the children’s rights protection system, sold the apartment by means of a proxy issued by her brother when he was alive.
CDC sought to annul the sale contract on the ground that the validity of the proxy expired the day when the man died. Later, the children’s aunt initiated a reconciliation agreement which failed because the children’s mother did not accept the proposed sum.
At the moment, the mother and the three children, aged 16, 14 and 12, are renting an unfitted room
