Court annuls prosecutors’ ordinances not to institute criminal proceedings against ex-MP

The National Integrity Authority (NIA) won a case against the Buiucani Office of the Chisinau Prosecutor’s Office, which refused to take legal action against former MP Nae-Simion Pleșca, IPN reports.

At the end of last December, the NIA completed the inspection procedure in relation to the ex-MP. It ascertained a substantial difference of over 800,000 lei in the incomes declared by Nae-Simion Pleșca. The integrity inspector submitted a denouncement to the Prosecutor General’s Office so that this started a criminal case over unjust enrichment. In February 2021, the prosecutor in charge of the case refused to institute criminal proceedings against the ex-MP for the reason that the elements of an offense were absent in the facts discovered by the NIA.

The NIA asked that the order should be annulled, but the Buiucani Office issued another ordinance by which this request was rejected. As a result, the integrity inspector went to court.

On May 19, the Ciocana branch of the Chisinau City Court accepted the NIA’s complaint, nullifying prosecutors’ ordinances and ordering to resume the penal process.

The court judgment is not yet definitive.
