Corruptible elements found in Law on land demarcation

The draft amendment to the Law on public lands and their demarcation contains corruptible elements. The conclusion was reached by the Center of Analysis and Prevention of Corruption (CAPC) after an expertise on the document’s corruptibility, Info-Prim Neo reports.
CAPC expert Viorel Parvan told the press on Friday, June 22, that the demarcation of public lands was a sensitive field and that the legislation concerning it was too vague.
“Corruptible elements are related to some exceptions, such as the exclusive execution of works only by state enterprises founded by the Real Estate Relations and Cadaster Agency. The current law offered this possibility to specialized private companies as well. The amendment offers the Agency additional competences that allow abusive interpretations and exceptions. The Agency could get the right to examine errors committed in the development of territory organization in the context of land privatization, to correct these errors and to not take them into consideration in the formation of the state’s public land property”, Viorel Parvan told Info-Prim Neo.
According to him, the property rights of natural and juridical persons and even administrative-territorial units could be infringed as a result of such arbitrary powers.
Notwithstanding the mentioned issues, the expert thinks that the draft law as a whole is opportune for Moldova as it can contribute to the improvement of the legal framework concerning the demarcation public lands owned by the state and territorial-administrative units. Yet, it must be reviewed and adjusted to the Moldovan and the European legislation before being debated in the Parliament.
