Constitutional Court to pronounce on President election matter Sept. 20

The Constitutional Court will examine the application to interpret Article 78 of the Constitution, which describes the procedure for electing the head of state, on September 20 head of the Court’s press unit Dumitru Tara stated for Info-Prim Neo. The application was submitted by MPs Mihai Ghimpu, of the PL, Tudor Deliu, of the PLDM, and Raisa Apolschii, of the PDM. The authors said there are currently no constitutional and legal provisions obliging the legislative body to employ a sustainable procedure for electing the President and banning the repeated dissolution of Parliament if the head of state is not elected. The lawmakers asked the Constitutional Court to determine if the method of electing the President can or cannot be modified by organic law. Earlier this month, the leader of the PLDM Vlad Filat said his party will not take part in the amendment of the Constitution by organic law. In June, the Venice Commission made public its stance, saying it is within the remit of the Constitutional Court to interpret the constitutional provisions concerning the election of the head of state, but the best solution is to modify the supreme law.
