“The Man and the Universe” scientific society called upon President Nicolae Timofti and Speaker Marian Lupu to introduce the expression “acknowledging the laws of nature and of the Creator” in the preamble of the next Constitution, Info-Prim Neo reports.
The alleged goal is the spiritual rebirth of the people, the return to its divine and ancestral origins. According to the signers of the petition, similar stipulations are contained in the constitutions of Ukraine and Greece and the U.S. Declaration of Independence.
Constitutional expert Corneliu Gurin told Info-Prim Neo that such a proposal depends on the whole text of the document. “So far, Moldova is a secular state and the Church is separated from the State, and the latter’s laws are for all of its citizens, while the laws of the Creator are only for the adepts of one religion or another. The issue of ‘nature’ doesn’t concern the Constitution either. It’s a philosophical-human issue”, said Corneliu Gurin.
Regarding other constitutions containing this formulation, the expert claims that older constitutions do contain it, as a result of discussions and events that took place over hundreds of years and these constitutions weren’t changed because nobody deemed it necessary. “Modern constitutions don’t include such formulations because it means dividing people into believers and non-believers, a differential treatment for those without faith”, explained the expert.
Corneliu Gurin thinks that this idea is a provocation and the main problem is that the process of preparing changes to the Constitution isn’t a public one, because many could come up with various proposals and there would be no interpretations.
Previously, several political forces proposed to adopt a new Constitution, with changes regarding the process of electing the head of the state in order to avoid political crises like the last one, when the Parliament couldn’t elect the President.
