The municipal councillors do not want to comply with the court decisions by which the Chisinau Municipal Council (CMC) is obliged to privatise the plots of land in the municipality of Chisinau. This subject had been discussed at the CMC’s meeting of December 4 for over an hour and a half, but the 31 decisions regarding land lease and the 45 decisions on the privatization of plots adjoining private facilities were not approved. The councillors took a break until December 7 to familiarize themselves with the legal provisions that prohibit the courts from obliging the municipal councillors to vote in a certain way. The CMC chairman Mihai Ghimpu told Info-Prim Neo that the courts make illegal decisions as they do not have the right to force CMC to vote for the privatisation of land. According to him, the law that regulates the normative price says that it is up to the CMC to decide on the lease or sale of the land. The courts can only compel CMC to examine such matters and only if the Council breached the one-month term during which it should have examined such applications from the citizens, he said. At the same time, Ghimpu said that the courts demand that the municipality privatise the land at the normative price, which is much smaller than the market price. Those that would purchase the land at the normative price, would become millionaires overnight because they can sell the land at the market price the second day, the cited source said. The draft decisions discussed at Tuesday’s meeting as well as another 300 matters that will be examined at the next meeting are “debts” of the former local councils. Most of them have been formulated under court decisions that favour the applicants.
