Children claiming right on their deceased father’s apartment

Three children from Chisinau are claiming in court their right on the apartment of their deceased father. The flat was sold by the children’s aunt, immediately after her brother’s death, with the help of an invalid proxy. According to the Centre for Children’s Rights (CDC), an organisation which represents minors’ interests in court, after the divorce of the parents the children were raised by their mother. The man passed away in August 2006. According to the legislation in force, his apartment in Chisinau is to be due to his 1st degree inheritors - his three children in this case, aged 16, 14 and 12. Shortly after the funerals, the man’s sister, a professional in the children’s rights protection system, sold the apartment by means of a proxy issued by her brother when he was alive. CDC sought to annul the sale contract on the ground that the validity of the proxy expired the day when the man deceased. The court is to pronounce a decision on the case on November 6. According to CDC, the family which is currently renting an unfitted room is hoping that the court will adopt the correct decision and let the children enjoy their legal right to have a home. The Centre for Children’s Rights is an NGO offering legal protection and other support to children and youngsters. Other beneficiaries of the Centre are specialists working with children, central and local public authorities specialised in defending children’s rights; national and international organisations.
