The exams to enter the Bar will be recorded by audio and video equipment so as to ensure transparency. Such a provision is contained in a bill to amend and supplement the Law on Advocacy that was approved by the Government, IPN reports.
Under the bill, the written test will be taken on the computer and will contain the same questions for all the contenders, while the results will be assessed in comparison. “This will enable to eliminate any speculation about the contenders’ behavior as these will all have to answer the same questions,” said Minister of Justice Vladimir Cebotari.
Other changes refer to the Advocacy Admission Commission. Its members will be selected by the General Assembly of Lawyers, as before 2010. “Now the members of the commission are chosen by the Lawyers Union, which is often accused of promoting only persons close to it. So the admission commission is not an incontestable mechanism,” said he minister.
There will be set up a Challenges Commission that will examine the applications of the contenders who will disagree with the score they will get. The commission will include members of the Lawyers Union, representatives of civil society and of the academic community.
The bill also says that the lawyers on probation will be able to assist the guiding lawyer at any stage of the trial. The persons with at least 10 years of seniority as judge or prosecutor will be exempted from probation. These will only submit an application to take the qualification exam to enter the Bar, but will be obliged to attend courses on deontology and administration of the forms of advocacy for 36 hours.
