CES annuls CES Chisinau’s decision concerning groups with extended hours

The Commission for Emergency Situations (CES) annulled the recent decisions on the functioning of groups with extended hours in schools taken by CES Chisinau, IPN reports.

After the CES’s meeting, Minister of Education and Research Dan Perciun said that the responsibility for ensuring the groups with extended hours lies with the local public authorities. “The solution was identified (by the City Hall) through the municipal Commission for Emergency Situations, but this does not have such powers - to levy such taxes on parents without providing funding from the municipal budget,” stated Minister Perciun.

CES also annulled CES Chisinau’s decision by which the order to terminate the employment relationship with the head of the municipal Division of Education, Youth and Sports Andrei Pavaloi was declared illegal. Dan Perciun said that Andrei Pavaloi was promoted to the post in breach of the law as there was held no competition to fill the position and he was appointed for an indefinite period of time.

“These decisions were annulled because the Chisinau Commission for Emergency Situations abused its authority. This Commission doesn’t have such powers – it cannot ascertain an exceptional situation in the education system and cannot cancel the orders of the minister. Respectively, from our viewpoint, what happened is an obvious abuse of power and we will request the responsible institution to assess and penalize those to blame for exceeding the authority,” said the minister.

CES Chisinau decided that the groups with extended hours in primary and secondary schools will work based on temporary regulations, which provide that the monthly fee for groups with a program extended by three hours will be 360 lei, while for groups extended by six hours – 690 lei. The Commission also ascertained an exceptional situation in the education sector. In a decision, CES Chisinau noted that the orders by which the minister of education and research terminated the service relationship with the head of the General Division of Education, Youth and Sports Andrei Pavaloi were illegal.

In reaction, the Chisinau City Hall said that the minister of education made political statements on the work of the Chisinau City Hall and Municipal Council on various topics, which is not within his remit. “We consider these actions represent pressure on the local authorities. We will comment on other decisions taken by the Chisinau City Hall later,” said the municipality.
