Four of the six judges of the Constitutional Court (CC) can ensure a quorum no matter which institution designated them. Pronouncing on a challenge filed by MP Sergiu Sarbu, the CC ruled that the legal provision saying the Court can work with at least four of the six judges only if they represent all the three authorities that can delegate constitutional judges are unconstitutional, IPN reports.

Two of the six constitutional judges are proposed by the Government, two by Parliament, while the other two by the Supreme Council of Magistrates.

The Court said there are no objective and rational arguments for obliging the CC to work only if all the three authorities are represented in it, while the disputed norm may block the institution’s work and make it dependent on the actions of other authorities. It stated that it experienced such a situation between February 23 and April 5, when Parliament couldn’t name its representative.
