The case of Andrei Braguta, who died in penitentiary at the end of this August, revealed the errors existing in the system. Furthermore, there is a problem in the police system as regards reporting. Such opinions were stated in the talk show “Emphasis on today” on TVR Moldova channel, IPN reports.

According to lawyer Vadim Vieru, the videos show that the police officers, even if they could and were obliged to intervene to stop the ill-treatment of Andrei Braguta, practically consented to this.

The lawyers for the family of Braguta consider those videos shouldn’t have been made public even if they shed light to some extent. The family didn’t give its consent, but those images have a rather violent content that evidently affects all the members of the family and society in general. “This case presents very well all the system errors,” stated Vadim Vieru.

Sergiu Ostaf, director of the Resource Center for Human Rights (CReDO), said the remand prison’s police officers on guard should have reported the case of violence. This wasn’t done and this is actually a system fault. “The problem resides in the police system and this is clear. The responsibility in this case is borne by the policemen on duty, the medical service that provides assistance of a poor quality and the superiors who manage the cells as these didn’t develop prevention systems,” stated Sergiu Ostaf. According to him, the system for ensuring the human rights in remand detention should be reviewed.

Ex-minister of justice Vladimir Grosu noted there is a system problem as regards reporting. “It is evident there is no system for reporting to the superiors and a system for reacting to such problems,” he said, adding that the shifting of responsibility from one institution to another does nothing but increase the people’s distrust in justice.

Seven persons – three inspectors of the remand prison of the Chisinau Police Division and four detainees – will appear before court in the case of Andrei Braguta. According to the Prosecutor General’s Office, the policemen are accused of allowing four cellmates of the victim to commit acts of torture against Andrei Braguta and of subjecting the man to inhuman treatment.
