CAPC recommends hastening adoption of legislative amendments on gender equality

The changes made to the Law on the Government and the Law on the Media in terms of human rights are aimed at adjusting the legislative framework so as to implement the national policies on gender equality and honor the international commitments assumed by Moldova. The Center for the Analysis and Prevention of Corruption (CAPC) approves of the adoption of the given bill by Parliament in the first reading and recommends passing it in the final reading before the elections.

In a news conference at IPN, CAPC expert Ion Beschieru said the bill is in agreement with the constitutional norms and adjusts the legislative framework to the Law on the Equality of Chances between Men and Women. It obeys the international standards and the recommendations of the Committee of Ministers of the Council of Europe.

The bill institutes a women’s quota of at least 40% on the formation of the Cabinet and the Parliament’s Standing Bureau. It obliges the political parties to ensure gender equality in their activity and in the composition of their administration. The parties will have to make sure that at least three persons of five consecutive persons on their election list are of the same gender. Such a formula can ensure gender equality, said Ion Beschieru.

As to the bill’s impact on the human rights situation, the CAPC considers that it will influence the exercise of the right to enjoy equal treatment on the part of the public authorities and not to be discriminated. The bill introduces measures that have a positive impact on the observance of human rights.

Ion Beschieru concluded that the main finding is that the examination of the bill is delayed, while experts expect that Parliament will pass it in the final reading before this autumn’s legislative elections so that it has an effect in the immediate period.

The CAPC assessed the bill within the project “Vulnerability appraisal of draft normative and legal documents” that is financially supported by MATRA Rule of Law and Good Governance of the Kingdom of the Netherlands.
