After two years and a half of trials and approaches made to the bodies of the local public administration, the dwellers of an apartment building situated at 5 Decebal St in Chisinau complain that justice is not made to them, but the security of their block with 93 apartments is at risk after the annex located nearby was demolished and a building is being erected in that place.

The block at 5 Decebal St earlier belonged to the state-run enterprise “Moldova’s Railways”. The building had an annex with several floors. At a certain stage, the annex became private property of a building company that demolished it so as to erect an apartment building in its place.

Artur Macovei, in a news conference at IPN, said that in the absence of the required documents that the Chisinau City Hall itself asked from the building company, this was issued with a building permit. “The head of Section (Section for Legal Entities, e.n.) Aliona Cazacu and senior specialist Gheorghe Furtună indicated that the set of documents presented for obtaining the building permit is incomplete, but the agreement of the block owner and the proceedings of the Assembly of Dwellers weren’t presented. Moreover, the fact that the City Hall later could not issue a building permit is confirmed by the brief by which the Division (General Architecture, Urbanism and Land Relations Division, e.n.) also informed mayor Ion Ceban that the building permit cannot be signed and issued to this block for the simple reason that those documents weren’t provided. So, the building permit was issued in the absence of the necessary documents that the City Hall itself asked from the company,“ stated Artur Macovei.

According to the lawyer, a condition is for the future building not to occupy more than one third of the area of the lot. But the company was authorized to erect a building on an area of 600 square meters on a lot of 1,100 square meters, which is more than a half. As a result, the new construction is situated very close to the buildings of the existing apartment building and the dwellers are deprived of the right to private life.

Parking places for vehicles weren’t earmarked near the block. Mutual visibility between the windows of the old and new buildings wasn’t ensured. “They indicated some invented figures in the project and the Architecture Division noted that the calculations are not correct and the given permit cannot be issued,” stated Artur Macovei.

The lawyer added that the irregularities reported by the dwellers were confirmed by the Technical Surveillance Agency. “The building works do not correspond to the execution project. What is more serious is that the Technical Surveillance Agency holds accountable this legal entity for making changes, fully demolishing constructions in breach of the law, not executing works to maintain, repair and reinforce constructions. As the dwellers say, a part of their building is being destroyed and this leads to insecurity and risks of a collapse of their apartments,” said the lawyer.
