Ban on standing for election for representatives of unconstitutional parties valid

The ban on standing for election imposed on representatives of political parties declared unconstitutional remains in force. Because of the equality of votes, the Constitutional Court (CC) suspended the examination of an application filed by a group of MPs who earlier formed part of the outlawed Shor Party, IPN reports.

The MPs asked the Court to establish the constitutionality of the legal provisions that ban the persons who were members of the elective body of a party or who held elective posts or were on the lists of substitute candidates of the given party when this was declared unconstitutional from running in elections for a period of three to five years.

The application started to be examined on September 14 amidst a protest mounted by the team of fugitive politician Ilan Shor and his sympathizers. The protesters accused the government of abuse of power and demanded to have their right to stand for election respected.

In the first meeting, the application authors asked that CC president Nicolae Roșca should not take part in the examination of the issue. The decision by which this request was rejected was made public in the September 19 meeting. Domnica Manole didn’t take part in the previous meeting and in Tuesday’s meeting on health grounds.

In the last meeting, the sides presented their positions. After 8pm, the CC gave its verdict. The Court’s president Nicolae Roșca announced that the examination of the challenged articles was stopped due to equality of votes.

The given decision is definitive, cannot be challenged, takes effect when it is adopted and is published in the Official Gazette.
