Application concerning constitutionality of nomination of PM inadmissible

The Constitutional Court rejected as inadmissible the application to verify the constitutionality of three decrees signed by President Nicolae Timofti to nominate Ion Paduraru as a candidate for Prime Minister, to annul this decree and to nominate Pavel Filip as a candidate for premiership. The challenge was submitted by the Socialist MPs, IPN reports, quoting a press release of the Court.

The authors of the challenge asked to nullify the three President’s decrees because Parliament didn’t pronounce by vote on the investiture/rejection of the Sturza Government, the parliamentary alliance was formed not legally, while the head of state used double integrity standards when nominating or refusing to nominate candidates for Prime Minister.

The Court ruled that the application refers especially to the violation of the procedure stipulated in the Constitution and the Parliament’s Regulations. As regards the invoked violations, the Court held that the authors of the challenge didn’t refer to the effects of the constitutional norms on the challenged documents.

It also said that the challenge is abusive because the Socialist MPs refused to take part in the formation of the Government and, namely due to their absence, the quorum at the special Parliament sitting was not present and thus the attempt to vote in the Sturza Government failed.

The Court ruled that the application is evidently groundless, was formulated abusively and was argued defectively and therefore rejected it as inadmissible.

The decision of the Constitutional Court is definitive and cannot be disputed. It takes effect when it is adopted and is published in the Official Gazette of the Republic of Moldova.
