The Chisinau Appeals Court dismissed as unfounded Marina Tauber’s request to annul the order made by the Commission for Exceptional Situations (CES) on October 4. By this order, the CES set down the individualization criteria referring to persons who cannot stand for election in the November 5 general local elections.
Contacted by IPN for details, the head of the Chisinau Appeals Court’s press service Adelina Roșca said that besides this suit filed on October 4, Marina Tauber also asked the Court to oblige the Balti District Electoral Council No. 2 to resume the process of examining the administrative file for registering her as a candidate for mayor of the municipality of Balti, making reference to provisions of the Constitution and the Electoral Code. The last request hasn’t been yet examined.
Adelina Roșca also said that following the CSE order of October 4, 2023, no other requests to annul decisions taken by Electoral Councils were made.
After the Constitutional Court declared some of the Electoral Code’s provisions unconstitutional, the Commission for Exceptional Situations made an order by which it specified the individualization criteria referring to persons who cannot stand for elections in the November 5 general local elections and how the given administrative decisions can be challenged in the Appeals Court. Shortly afterward, Parliament adopted amendments to the electoral legislation and these stipulate the criteria based on which members of a party declared unconstitutional will be prevented from running in elections.
Before the criteria were adopted, MP Marina Tauber applied to the Balti District Electoral Council to be registered as an independent candidate for the mayoralty of Balti. The electoral body refused to register her given that she was on the list compiled by the Central Election Commission.
