“Apa-Canal Chisinau” challenges Competition Council’s decision

The administration of “Apa-Canal Chisinau” disputed the Competition Council’s decision by which a fine of about 770,000 lei was imposed on it. A hearing in this case will be held at the Centru branch of the Court of Chisinau on February 28, IPN has learned from the supplier.

By the decision made on December 4, 2017, the Competition Council fined “Apa-Canal Chisinau” for not implementing a decision of 2012 concerning the termination of a contract for the pre-treatment of wastewater with increased concentrations.

The company paid the imposed fine, but the money will be paid back if the court annuls the challenged decision. The administration reminds that since May 2017 it has ended all the contacts for the pre-treatment of wastewater with business entities.

By its decision, the Competition Council obliged SA “Apa-Canal Chisinau” to pay a fine of about 770,000 lei after a business entity was forced to pay a differentiated tariff for services to accept wastewater into the municipal sewerage system. “Ivaro” SRL filed a complaint, saying the water supplier abused its dominant position and imposed illegal and non-transparent tariffs. More exactly, the company complained that it was obliged to pay a pre-treatment tax even if this service wasn’t provided to it.
