[Info-Prim Neo survey of the Series “Moldova-20! Whereto?” with constitutional law expert Veaceslav Marza] [ –Do you agree that Moldova’s pro-European orientation should be laid down in the Constitution in order to guarantee the continuation of the modernization process? Will this process be interrupted if no such provisions are included in the Constitution?] – The constitutional regulation of a principally known pro-European position, at least from the adopted normative documents and statements, would highlight even more Moldova’s willingness to implement European standards so as to become part of the EU politically as well. However, if the Constitution does not set out such a pro-European orientation, this will not affect the process of Europeanizing Moldova. We are at a stage when even Europe expects deeds from us and thus we should act as efficiently as possible. As to the amendment of the Constitution, any intervention must be based on objective legal reasons, if the Constitutional Court cannot overcome a related legal problem when extensively interpreting the supreme law, even if in accordance with the international documents on human rights. In fact, the Constitution is an extremely rigid fundamental act. [ - May the Constitution be amended in Parliament or by referendum? Will the entire political class, including the opposition, and, eventually, society back such amendments?] – I think that society would positively respond to such a question in a referendum. The paradox may be that the answer would be as evident as the people would not go to vote and the turnout would be poor. I consider society must be mobilized only in very important cases and we should not abuse the people’s patience. [ - How can such changes affect the Transnistrian conflict settlement process?] – I believe such amendments cannot affect the Transnistrian conflict settlement process.
