A dash cam can help the drivers not to fall into the trap of swindlers who intentionally cause road accidents so as to later ask for money from the driver, said Andrei Berescu, lawyer and a member of the law firm “Protection of Human Rights”. The lawyer has told IPN that from legal viewpoint, the violation of the road traffic rules by pedestrians is punished in accordance with the Contravention Code.
“If such abuses ate ascertained, the pedestrian can be fined up to 600 lei. If the pedestrian’s blame in the commission of the road accident is established, the driver whose car is damaged can ask for damages by filing a lawsuit. I recommend the drivers who fall into the traps of such persons, if sums of money are asked from them so as not to call the police and to resolve the conflict on the scene, to immediately report such abuses committed by alleged victims by filing a complaint and asking to take legal action in accordance with Article 190 of the Penal Code (swindle),” explained Andrei Berescu, who is a Master of Criminal Law.
Andrei Berescu also said that if a road accident occurs and the victim suffers minor bodily injuries, the police should be informed so that the accident is recorded. The victim should be then examined by a doctor so as to record the suffered injuries. If the guilt of the driver in the commission of the accident is proven, the victim can go to court to ask for damages. The guilty driver will be penalized in accordance with the law – a fine of up to 1,200 lei and five penalty points in the case of insignificant injuries and a fine of up to 1,500 lei and six penalty points in the case of minor injuries. If the victim does not have objections to the guilty driver, a relevant statement should be signed on the scene so as to avoid disagreements in the future.
The victim of a road accident enjoys many rights and this status can be given to any person who was caused damage by the offense/contravention.
The lawyer called on all the participants in the traffic not to remain indifferent if they are witness to an accident as anyone can experience similar situations. If they can provide video evidence, they should do it right away.
