5 years after passing Civil Code, theoreticians and practitioners still seek to improve it. Representatives of the judiciary and of the academic environment from Moldova, Germany, Russia, Ukraine and Romania attend a conference in Chisinau and discuss on the attainments, reserves and prospects of applying the Civil Code, Info-Prim Neo reports.
Justice deputy minister, Nicolae Esanu, who had drafted the Code, has said at the opening ceremony it's not an exaggeration to call the Civil Code “the state's economic constitution.” “This Civil Code was born hardly. The final result has not been so good as wanted, but anyway it is a huge step forward for that period, as its contents may be bettered.”
The chairman of the Superior Council of Magistrature, Nicolae Clima, has said year 2003, when a number of important codes were passed, was of cornerstone importance for the judiciary. The new Civil Code laid the bases of new legal relations, and introduced new notions later successfully applied in the judiciary practice.
Implementing the Civil Code was marked by endless discussions among theoreticians and practitioners. According to Mihai Poalelungi, a judge with the European Court of Human Rights, no agreement has been reached concerning certain terms as “good-faith gainer.”
The international conference dedicated to the Civil Code ends on September 19. The event is organized by the Human Rights Directorate of the Council of Europe, in cooperation with the Justice Institute from Moldova and the Law Faculty of the Moldova Statye University.
